Do I need to obtain a permit for a storable swimming pool?

A Building permit is required for all pools that can hold 24" of water or more.  Please refer to Swimming pools, Spas and Hot tubs located on the Town of Essex website for more specific rules and information on topics including barriers and alarms.

Approval from the Health Department is not necessary. Although it is recommended that homeowners NOT set up the pool over any part of the septic system. In most cases, the property file will document the location of the septic system. Additionally, the homeowner should install the pool 25ft down gradient from a private drinking water well. When the pool is drained or if it were to accidentally rupture, this separation distance is recommended so as to reduce the risk of such a large volume of surface water flooding the well area and potentially contaminating the drinking water well. The Health Director is available to provide guidance on a suitable location.

A Zoning permit is not necessary. It is recommended that the pool be located at least 20' from the property line if at all possible.
